Please read these Terms of Use ("Terms") carefully before using the website Moonport ("the App") provided by Christian Molz - Moonport ("we," "us," or "our"). By accessing or using the App or Website, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using the App.
1. Acceptance of Terms
By using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and any additional guidelines or policies applicable to specific features or services offered within the App. If you do not agree to these Terms or any of our policies, please do not use the App.
2. Registration
To access certain features of the App, you may be required to register an account. You can register using your email address, Apple login, or Google login. You are responsible for maintaining the confidentiality of your account information, and you agree to accept responsibility for all activities that occur under your account.
3. Your Use of the App
The App is intended for personal, non-commercial use only. You agree not to use the App for any illegal, unauthorized, or harmful purposes, including but not limited to: a) Providing false information during registration or creating multiple accounts; b) Interfering with the security or integrity of the App or any third-party applications or systems; c) Attempting to gain unauthorized access to any portion of the App or its related systems; d) Uploading or distributing any content that violates the rights of others or is harmful, offensive, or inappropriate; e) Engaging in any fraudulent or deceptive activities.
4. Portfolio and Scenario Function
The App may include a portfolio function that allows you to manage your crypto assets and a scenario function that lets you perform calculations based on different scenarios. You understand that the information and calculations provided through these features are for informational purposes only and do not constitute financial advice. You are solely responsible for any actions you take based on the information obtained from the App.
5. In-App Purchases
The App may offer in-app purchases through Google Play Store and App Store. These purchases may include but are not limited to virtual goods, premium features, subscriptions, or other digital content ("In-App Products"). Your access to and use of In-App Products are governed by the terms and conditions set forth by Google and Apple, as applicable.a) Purchases and Billing When you make an in-app purchase, you agree to pay the specified fees and charges associated with the selected In-App Products. Payment will be processed by the respective platform (Google Play or App Store), and you are solely responsible for any transaction fees or additional charges imposed by your payment provider.b) Refunds and Cancellations Refund policies for In-App Purchases are determined by Google and Apple. Moonport does not have control over refund requests, and you must follow the procedures outlined by the respective platform. Please review the refund policies of Google Play Store and App Store for detailed information.c) Subscriptions If the App offers subscription-based In-App Products, the following additional terms apply:i) Subscription Period: The duration of the subscription will be clearly communicated during the purchase process.ii) Automatic Renewal: Subscription plans may automatically renew unless canceled before the end of the current subscription period. You can manage and cancel your subscriptions through your Google Play or App Store account settings.iii) Changes and Cancellations: Moonport reserves the right to modify, terminate, or otherwise amend subscription plans. You will be notified of any changes through the App or other means.iv) Apple Terms of Use (EULA): By subscribing to In-App Products through the App Store, you acknowledge and agree to Apple's End User License Agreement (EULA) available at [Apple EULA](https://www.apple.com/legal/internet-services/itunes/).d) Responsibility You are solely responsible for maintaining the security of your account and preventing unauthorized access to In-App Products. Moonport shall not be liable for any unauthorized transactions or access to In-App Products.e) Disputes and Chargebacks Any disputes regarding billing, charges, or unauthorized transactions should be directed to the respective platform's support (Google Play or App Store). 6. Intellectual Property
All content, trademarks, logos, and intellectual property related to the App are the exclusive property of Moonport or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App solely for its intended purpose. You shall not reproduce, modify, distribute, or create derivative works based on the App or any of its content without our prior written consent.
7. Privacy
Your privacy is essential to us. Please refer to our Privacy Policy you find in the profile section to understand how we collect, use, and protect your personal information.
8. Disclaimer of Warranties
The App is provided on an "as-is" basis. We make no warranties or representations regarding the accuracy, reliability, or completeness of any information provided through the App. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.
10. Changes to Terms
We reserve the right to modify or update these Terms at any time. We will notify you of any changes through the App or other means. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of laws principles. For users in US and other, these Terms shall also comply with US and other laws and regulations.
